Acceptance of Terms

By accessing or using Inkognet ("we," "us," or "our"), you agree to these Terms of Service ("Terms"). If you do not agree, you must not use the Service.

Description of Service

Inkognet is a web application that allows users to chat anonymously with strangers, potentially based on shared interests, through text or video. The Service includes advertisements and uses Cloudflare Turnstile for user verification. The nature of chats, including whether they involve 18+ content, is determined solely by users. We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice.

Eligibility

You must be at least 13 years old (or 16 in the EU) to use the Service. To engage in or access chats involving 18+ content (text or video), you must be at least 18 years old. By using the Service, you represent that you meet these age requirements and have the legal capacity to enter into these Terms.

User Conduct

You agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Engage in harassment, bullying, hate speech, or threats.
• Share explicit, obscene, or harmful content in chats with users under 18 or in non-18+ contexts.
• Transmit spam, unsolicited advertising, or malicious content (e.g., viruses, malware).
• Impersonate others or provide false information, including about your age.
• Interfere with or disrupt the Service (e.g., hacking, DDoS attacks).
• Violate any applicable laws, regulations, or third-party rights.

Community Guidelines

To ensure a safe and respectful environment, you must:

• Treat others with respect and avoid offensive language or behavior.
• Refrain from sharing personal information that could identify you or others, especially in video chats.
• Ensure all participants in 18+ chats (text or video) are 18 or older, and do not share explicit content with minors or in non-18+ contexts.
• Report violations, including inappropriate or explicit content, to [email protected].

We may remove content or suspend users who violate these guidelines.

Content Ownership and Responsibility

Your Content: You retain ownership of content you post or transmit (e.g., chat messages, video streams). By posting, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display it as necessary to provide the Service.

Responsibility: You are solely responsible for your content and its legality, including ensuring it complies with age restrictions. Inkognet does not control, monitor, or endorse the content of user chats (text or video), and we are not responsible for user-generated content that may be inappropriate, offensive, or explicit.

18+ Content

The nature of chats on Inkognet, including whether they involve 18+ content (text or video), is determined solely by users. You must:

• Confirm you are 18+ before engaging in or accessing 18+ content.
• Not share explicit content with users under 18 or in non-18+ contexts.
• Ensure all participants in 18+ chats are 18 or older.

Inkognet is not liable for user-generated 18+ content. You are responsible for ensuring compliance with age restrictions. Report inappropriate content for review at [email protected].

Video Chats

If you use Inkognet’s video chat feature, you agree to:

• Use video chats in compliance with these Terms and Community Guidelines.
• Not share explicit or inappropriate content with users under 18.
• Understand that sharing personal information (e.g., your face, voice, or surroundings) is at your own risk, as Inkognet cannot control how other users may use or share such information.

Inkognet does not store video content but may retain metadata (e.g., session duration) as part of session logs.

User-Generated Content

We do not control or assume liability for content posted or shared by users, including in text or video chats. We may remove or restrict access to content that violates these Terms, Community Guidelines, or applicable laws at our discretion.

Cloudflare Turnstile

Inkognet uses Cloudflare Turnstile to verify users and prevent bots. By using the Service, you agree to Cloudflare’s data collection practices as outlined in their Privacy Policy.

Intellectual Property

The Service, including its design, code, and branding, is owned by Inkognet and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written permission.

Third-Party Links and Ads

The Service includes ads and may link to third-party websites. We are not responsible for their content, privacy practices, or availability. Interacting with ads or third-party links is at your own risk.

Safety and Moderation

We aim to provide a safe environment but cannot guarantee the conduct of other users or the nature of their content. Report abusive behavior or inappropriate content (text or video) to [email protected]. We may suspend or ban users who violate these Terms or Community Guidelines.

Termination

We may suspend or terminate your access to the Service at our sole discretion, with or without notice, for reasons including:

• Violation of these Terms or Community Guidelines.
• Prolonged inactivity.
• Legal or security concerns.

Upon termination, your right to use the Service ends immediately.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

Limitation of Liability

To the fullest extent permitted by law, Inkognet, its affiliates, and employees will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of data, profits, or goodwill, or for any user-generated content (text or video) that may be inappropriate, offensive, or explicit. Because the Service is offered free of charge and without user registration, our total liability shall not exceed an amount of INR 8,000 (approx. USD 100) or the equivalent value in your local currency, even if any legal action arises.

Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages (including legal fees) arising from your use of the Service, the content you share (text or video), violation of these Terms, or infringement of third-party rights.

Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall be resolved under the exclusive jurisdiction of the courts of India.

Changes to These Terms

We may update these Terms to reflect changes in the Service or legal requirements. We will notify you by posting the updated Terms on the Service with a new "Last Updated" date. Continued use after changes constitutes acceptance.

License

All content and code provided in the Inkognet web app are the exclusive property of Inkognet. Unauthorized use, modification, distribution, or reproduction of the code or content is strictly prohibited.
